We want to update you on our ongoing legal action against the State of Washington and several community colleges. Following a recent decision in our lawsuit, we have filed an appeal to the Supreme Court. Your continued support is essential as we fight for the rights of public employees like you.

Background on Our Lawsuit

On November 22, 2024, WPEA filed a lawsuit against the State of Washington and multiple community colleges for bad faith bargaining. The state has taken an unlawful stance by:

  • Claiming it lacks the authority to bargain a full two-year contract for the 2025-2027 biennium.
  • Insisting that previously agreed-upon tentative agreements (TAs) are void, forcing negotiations to start from scratch.
  • Asserting that state law prevents them from requesting funding for our contract beyond the October 1st deadline.

Since returning to the bargaining table, the state has tried to limit negotiations to the second year of the contract (starting July 1, 2026), violating Washington’s collective bargaining laws and undermining public employees. Although some progress has been made, the state’s actions in September were still illegal and harmed our ability to reach a ratifiable agreement in time for funding approval.

This case is about more than just missed deadlines—it’s about ensuring the state negotiates in good faith and reaches a fair contract for our members.
