We Lost the Ruling—But Our Fight Has Just Begun
The judge has issued a decision denying our motion for a preliminary injunction . While this is not the outcome we hoped for, our strength doesn’t just come from legal outcomes—it comes from our community ties and collective action.
The judge’s ruling reads:
“Plaintiff’s Motion for Preliminary Injunction is DENIED. While Plaintiff takes issue with certain negotiating or bargaining tactics employed in this case and those tactics may, at times, be fairly described as aggressive, on this record, none of the complained of actions violate the law. Accordingly, it would be inappropriate to issue a preliminary injunction prohibiting such conduct and the Motion is DENIED as a result.”
We intend to appeal this decision. In the meantime, we need you—our members—to demonstrate that our power at the bargaining table comes from the power we leverage every day.
How You Can Take Action Right Now:
1. Attend Bargaining Sessions as an observer. OFM may want to hide their tactics, but we’ll shine a light on them. Starting on the bargaining session scheduled for January 14th, we’re opening bargaining sessions to all members. Additional information will be sent out in the coming weeks. 2. Know Your Contract, Know Your Rights Enforcing the contract starts with us. Study your rights. Contract enforcement is one of the strongest tools we have as a union. Exercise your rights. Report all workplace changes to your stewards or representative . Management must send mandatory notices before making changes, and we can file demands to bargain even if they don’t. This shows we’re organized, vigilant, and ready to act. 3. Talk to Your Co-Workers about Being Engaged. Build connections, talk about shared struggles, and form goals to solve them. Share your victories, your struggles, and your voice with other WPEA communities and attend UNITY meetings every Wednesday at 12 PM, 5 PM, and 6 PM . Strength is built through everyday solidarity.
